Fastcase has made many changes lately; from adding new partner content; to its new platform, Fastcase 7; and its latest 7.4 upgrade, code-named “VENUS.”

With 7.4, you can now:

Jump directly from your search results into the Outline View to learn which libraries are part of your current subscription

Quickly see which cases have been overturned because they are now highlighted in red in the Interactive Timeline

Home in on the best possible results because in 7.4 Fastcase overhauled its relevance algorithm to show the best results on the top of the results list

Fastcase has also added these new partners to offer subscribers more secondary content, such as:

Expert witness profiles from JurisPro: Brief annotations about the experts are integrated right into your search results if you run an “Entire Database” search. Then, if you click an annotation from the results list, the full-text of the expert’s profile is shown (for free). You can also search JurisPro on its own or in combination with other databases on Fastcase. Another expert witness profile database, Courtroom Insight, is new to Fastcase, but you can’t get a free look at the expert’s full-text profile like you can with the expert witness profiles from JurisPro. You can only see the brief annotation unless you have a separate subscription to Courtroom Insight.

American Bar Association Sections’ books and treatises are not online yet, but when they are the will be treated like the expert witness results above. You will see brief annotations integrated into your search results, but unlike the free access to the full text of Jurispro’s expert witnesses’ profiles, you will not be able to view the full-text of any book for free. You must have a separate annual subscription to an individual ABA book or a practice section library of online books in order to access the full-text. The ABA books will join a group of other book publishers already online at Fastcase, such as James Publishing, HeinOnline, the New York State Bar Association, and others.

TransUnion TLOxp: This is an investigative research database used for due diligence and to find missing people, etc. We have an individual TLOxp subscription and wonder if there’s going to be a discount if we subscribe via Fastcase. We’re awaiting a call-back to clarify this detail.

If you want to search Fastcase’s secondary materials, such as the expert witness profiles or any books and treatises, you will learn that Fastcase does not make it that easy to find them, so here’s how to find them: To view secondary material that is not jurisdiction-specific, such as JurisPro, Courtroom Insight, and books and treatises that are not from a state bar publication department, click Outline from the homepage and then choose All-Federal or any state to view the available books and treatises. To view only state-specific secondary materials, such as books and treatises from the New York State Bar Association, click Outline from the homepage and then click New York.

In an earlier post, we reported that TLOxp announced a forthcoming “Relationship Report,” which allows subscribers to simultaneously run one report comparing the assets (typically this refers only to real property and vehicles—not bank accounts or stocks) and showing other connections between two subjects. Pricing had not been announced at that time. Now that we have tried out the Relationship Report, taking advantage of the Feb.15-29, 2016 free promotion, we can inform you of the pricing and offer our opinion about the Report.

First, to pricing: A report comparing two subjects is priced at $19. You can add additional subjects at $3 per subject. The price of the interactive diagram showing the connections is $2. Note: You will first have to run a $2 search for each subject (to select the correct subject) and then add that subject to your Favorites folder.

Second, to our opinion: We’re on the fence. Our two subjects had nothing in common according to the Relationship Report.

However, when we manually compared subject one’s and subject two’s comprehensive reports to each other, we noticed that people with subject two’s last name appeared in the possible associates, possible relatives, and neighbors sections of subject one’s report. Although these names did not appear in subject two’s comprehensive report, it is still conceivable there could be a connection between my two subjects. We would prefer to see these types of possibilities in the Relationship Report so we could at least have the chance to explore further, either by more research or simply asking my two subjects (via interrogatories or at deposition) about their relationship with the people in question.

We recently wrote about changes to the access and pricing structure for the pay investigative research database TLOxp, in the post “TLOxp Raises Prices, Requires Site Visit for All Subscribers.” At that time we wondered if the newly required site visit that we were about to undergo would entitle us to access full Social Security Numbers and Dates of Birth. We have subsequently undergone the site visit we discussed in that earlier post.

While we never received official notification that we passed the site visit, it appears that we must have - because our most recent searches are displaying full Social Security Numbers and Dates of Birth.

So, the answer to our question about whether a site visit would automatically entitle us to full Social Security Numbers and Dates of Birth is a resounding “Yes.”

We have subsequently undergone the site visit we discussed in that earlier post.

While we never received official notification that we passed the site visit, it appears that we must have – because our most recent searches are displaying full Social Security Numbers and Dates of Birth.

So, the answer to our question about whether a site visit would automatically entitle us to full Social Security Numbers and Dates of Birth is a resounding “Yes.”

November 8, 2015
by Carole Levitt JD MLS & Mark Rosch

For investigative research database searching, we have been recommending TLOxp to lawyers for many years because it was inexpensive and did not require a monthly or annual subscriber fee. While the search began at 0.25 and quickly went up to $1.00 and then $2.00, and the comprehensive report went from $5.00 to $10.00, a subscriber fee was never instituted.

On November 5, 2015, we received an email notifying us that all that is about to change effective January 1, 2016. TLOxp will be instituting a $25 monthly minimum spend requirement. You can avoid this spend requirement if the sum of your monthly usage is greater than $25, but if you fail to meet the $25 monthly minimum, you will be assessed $25.

Another new requirement is that you now must submit to a $60 site visit. In the past, this was optional; you only had to submit to a site visit if you wanted access to full Social Security Numbers and Dates of Birth. It is unclear if the new site visit requirement will now entitle all users access to full Social Security Numbers and Date of Birth. TLOxp explains the reason for the mandatory site visit this way: “To help ensure the highest standards for data security, TransUnion is conducting a periodic compliance validation, including updating information we maintain about users and your organization. This includes conducting a site visit for the location from where you access the TLOxp account.”

Unlike the new $25 minimum monthly spend, the site visit won’t actually cost you anything because, “Your invoice will be credited back $10 per month over a six-month period starting in January 2016, once the compliance validation is performed.” TLOxp has given customers very little notice to complete their site visit—it must be completed by December 15, 2015. During the site visit, TLOxp will be looking at four main areas at your office:

Verification that the company information provided during the credentialing process is accurate. This covers questions such as whether your company is located at the address provided, and if it appears to be operating as the business type represented.

Security review around how the information is accessed. Is there a keyed locked office and a locking filing cabinet, an alarm or security present, the computers accessing systems limited to employees only, and screens situated to where only employees can view the screens, etc.

Information destruction. Shredders or a service that provides secure document destruction is common.

Secure storage of information obtained from the system. Locks on the file cabinets or file rooms where printed reports may be stored would be expected. Antivirus or security software should be installed on systems that will be accessing the data

If you are operating from a home-based location, prior to the site visit, TLOxp wants a documented response about the following issues, within five (5) calendar days of your $60 site visit payment:

Whether the office is in a dedicated space, separate from the living quarters. The office must be for the sole use of the business and not located in a multi-use room. Indications of multi-use include beds, recreational equipment such as pool tables, and exercise machines.

Whether the dedicated office space is separated by a keyed lockable door.

Whether secure storage for any printed reports or documents in the form of a lockable file cabinet exists.

With their access to public records, publicly available information, and proprietary information not available elsewhere, pay investigative research databases are important tools lawyers can use to uncover background information about people or help locate people who are not always easy to find.

Today, TLOxp announced a forthcoming “Relationship Report,” which will allow subscribers to run one report automatically comparing the assets (typically this refers only to real property and vehicles—not bank accounts or stocks) of two subjects, as well as showing other connections.

"This additional investigative tool will save you valuable time by running one report connecting both subjects, compared to running two individual reports and then manually comparing the contents of two separate reports," the company said in the User Guide that also served as a de facto announcement of the tool.

The report is accompanied by an interactive diagram showing the connections.

When TLOxp launches this new Report, subscribers simply add the names of their research subjects to a Favorites folder and then select any two subjects in the folder on whom to run the comparison report.

TLOxp has not announced the cost of this Report, but states that it will be available on a transactional basis, so it WILL NOT BE part of your pricing plan if you have a flat rate. Once the Report is launched, you will be able to view the pricing options by clicking the Pricing link in the My Account tab.
